Terms & Conditions

These terms and conditions apply to all bookings made with Chalet La Motte which is the trading name of Martin Harris (EI)

1. Deposits

Please check for availability and prices before booking. For any holiday we require a non-refundable deposit of 20% of the booking cost. If your deposit payment is not received within 10 days then the holiday may be offered to other interested parties. Upon receiving your deposit and booking form, we will send confirmation of your reservation and an FAQ document. In case of all parties or groups comprising more than one individual the client who confirms the booking will be liable for all persons in the party both in terms of payments and ensuring compliance with these terms and conditions. In case of individual bookings the confirmer is responsible.

2. Payment of holiday cost

The balance of your holiday cost must be settled 8 weeks prior to the commencement date of your holiday. If your holiday booking is made within 8 weeks of commencement then payment must be made in full immediately on booking. If payments are not made in accordance to this schedule then bookings will be treated as cancellations and deposits will not be refunded.

3. Skiing, snowboarding and Mountain Biking

Chalet La Motte accepts your holiday booking on the understanding that you recognise the hazards involved in a winter or summer sports holiday. We will not be held responsible for any loss or injury which occurs whilst taking part in these activities. In addition we cannot be held responsible for any inconvenience or discomfort due to factors out of our control especially those associated with mountain environments – for example extreme weather conditions or lack of snow.

4. Insurance

Each person booking a holiday at Chalet La Motte must have adequate insurance cover. We will not accept anyone without adequate holiday insurance cover and will be entitled to exclude them from the chalet and cancel their holiday without compensation.

5. Cancellation by the client

Cancellation shall take effect only when we receive written (email is acceptable) notification from the person confirming the booking. All written correspondence should be addressed to Chalet La Motte, 1021 Route De La Motte, Saint Sigismond 74300, Haute Savoie, France. In all cases of cancellation the deposit will be forfeited. The following cancellation fees expressed, as a percentage of the total holiday cost will be refundable by Chalet La Motte. If a member of your party wishes to cancel, this may mean that the chalet booked is no longer fully occupied and result in the other members having to pay any applicable supplements to retain the booking. 

Cancellation with more than 8 weeks notice; Deposit forfeited

Cancellation within 8-6 weeks; 60% of holiday cost refunded

Cancellation within 6-4 weeks; 40% of holiday cost refunded

Cancellation within 4-2 weeks; 20% of holiday cost refunded

Cancellation within 2 weeks; 0% of holiday cost refunded

5.1 Cancellation by the client due to Travel Restrictions e.g. due to Covid 19

If in the event of any alteration having to be made by the client due to a formal government issued travel restriction to France or the Auvergne Rhône Alpes region, we will offer you one of the following options I) To accept the new arrangements II) To cancel your holiday and receive a full refund. We will not be liable for refunding any expenses which have been occurred as a result of the booking. We will also not provide refunds for cancellations due to quarantine procedures on return to the clients home country.

6. Alteration by Chalet La Motte

If in the unlikely event of any alteration having to be made by us, we will notify you as soon as possible and offer you one of the following options I) To accept the new arrangements II) To cancel your holiday and receive a full refund. We will not be liable for refunding any expenses, which have been occurred as a result of the booking.

7. Changes

Should you wish to change your booking dates, we will endeavour to accommodate any changes subject to any differences in price and availability, but cannot guarantee that changes can be made. Chalet La Motte will make an administration charge of €50 for any change in booking. Bookings cannot be changed within 2 weeks of the start of your holiday.

8. Behaviour & Damages

While on holiday with us you promise to behave in an acceptable manner which does not threaten the condition of the chalet or disturb the enjoyment of other guests or our neighbours. If you cause any damage to the chalet, fittings, equipment or any loss of contents or equipment, you will be liable for the cost of repair or replacement. Full payment must be made to Chalet La Motte at a price determined by us. If payment is not made then the responsible party will indemnify Chalet La Motte against any claims (including legal costs) subsequently made against us as a result. If your behaviour or that of any member of your party seriously impairs the enjoyment of any other guest or neighbours, we reserve the right to refuse to further accommodate the party responsible, who will forfeit the holiday cost and deposit.

9. Responsibility

Chalet La Motte will not be liable for any loss or damages incurred by any client as a result of:

  1.  Any event or circumstance which could have been avoided if the client had taken reasonable care.

  2.  Any circumstance or event which Chalet La Motte or its suppliers could not have foreseen or prevented even with all due care and attention.

  3. Circumstances out of the reasonable control of Chalet La Motte such as strikes, wars, civil or political unrest, quarantine restrictions, terrorism, government actions, natural or nuclear disaster adverse weather conditions including lack of snow or injury or illness to staff thus reducing level of service.

  4. Injury, illness or death due to any activity, including skiing or snowboarding on or off piste, at any time during your holiday, except where such injury or death is caused by the negligence or fraud of Chalet La Motte.

  5. Loss of, theft of or damage to any of your belongings at any time of your holiday, whether within the chalet, in the neighbourhood or on the piste or otherwise.

 
10. Passports

It is your responsibility to ensure that you are in possession of all necessary travel and health documents prior to departure from your home country e.g. Negative Covid test results. All costs incurred in obtaining such documentation must be paid by you. We regret we will not accept any liability if you are refused entry onto any transport or into France due to the failure on your part to carry correct documentation. If failure to have any necessary travel or other documents results in fines surcharges or other financial penalty being imposed on Chalet La Motte, you will be responsible for reimbursing us accordingly.

11. Complaints and Problems

In the unlikely event that you have any reason to complain or experience any problems with your holiday whilst here, you must immediately inform the Chalet La Mote hosts and the supplier of the service(s) in question. Any verbal notification must be put in writing and given to us and the supplier as soon as possible. Until we know about a problem or complaint, we cannot begin to resolve it. Most problems can be dealt with quickly. If you remain dissatisfied, however, you must write to us within 28 days of your return to the your home county giving your name and full details of your complaint. We regret we do not accept any liability in relation to any complaint or claim which is not notified entirely in accordance with this clause.

12. Non-smoking chalet

For the comfort of all our guests and for safety reasons Chalet La Motte is a non-smoking establishment. There is a deck area outside the chalet for those who wish to smoke. Any breach of this clause shall be regarded as a material breach and may result in the client being removed from the chalet.

 
13.  Arrival/Departure Times

Your room in the chalet will be available after 4:00 p.m on the day of arrival and must be vacated by 10:00 a.m on the date of departure.  Storage facilities will be available in the chalet, if required.

 
14. Website Accuracy

Please note the information and prices shown in this website may have changed by the time you come to book your holiday. Whilst every effort is made to ensure the accuracy of the website and prices, regrettably errors occasionally do occur. You must therefore ensure you check all details of your chosen holiday (including the price) with us at the time of booking. The website is the sole responsibility of Chalet La Motte. It is not issued on behalf of and does not commit any independent organisation/carriers whose services are featured in it.

All terms and conditions shall be governed by and construed in accordance with French Law. The parties submit to the exclusive jurisdiction of the French courts
